Another worker status challenge begins

Another employment tribunal hearing has commenced this week, where eight courier drivers have issued proceedings against Hermes.

Hermes describe their drivers as ‘lifestyle couriers’ who use their own vehicles to deliver goods from retailers such as Next and John Lewis.  They are considered to be self-employed by Hermes who are of  ‘a traditional kind’. These drivers are also paid according to the number of parcels that they deliver which often falls below the national living wage.

The case is being sponsored by the GMB Trade Union who are supporting the drivers who are seeking arrears of  holiday pay, the national living wage and pension contributions.

This is the latest in a line of authorities on the status of those who work in the so called ‘Gig economy’ and as ever we will watch this space for the outcome and the employment tribunal judgment.
