  • Acting for developers acquiring options over airspace leases and development rights to construct additional storeys on residential blocks, including negotiating overage arrangements.
  • Advising a group of leaseholders on strategies to oppose the development of airspace above their building, including analysing planning permissions against lease rights and advising on injunctive relief for derogation from grant.
  • Acting for a landowner and their development finance provider on the structuring of an airspace development, including airspace leases, scaffolding licences, development agreements and joint venture arrangements.
  • Acting for a developer on the acquisition of the freehold of a residential block, including advising on aligning planning permission with existing lease rights and compliance with rights of first refusal.
