What is Defamation?

Defamation occurs when there are untrue allegation made to third parties against the reputation of individuals or businesses which serve to undermine them in the eyes of right-thinking members of society generally, by exposing the victim to hatred, contempt or ridicule.

If a defamatory statement is made verbally it is slander, but if it is published words then it is libel. The exception to this is in the broadcast media where untrue, defamatory statements made on TV or on the radio are dealt with as libel.

It is often a particularly complex area of law which turns on very specific facts within a particular case. The law around the interpretation of defamation is constantly evolving as new case law develops, in which case you should consult a specialist slander solicitor.
