Meaby & Co – Solicitors specialising in civil recovery and the proceeds of crime
Civil recovery and The Proceeds of Crime
Meaby & Co. are specialists in dealing with matters involving Civil Recovery and the proceeds of crime. We have a team of experts with the required technical ability and experience in dealing with these types of cases in both the civil and criminal courts. Our lawyers have worked on some of the most high profile civil recovery cases in the UK and internationally and have the expertise to advise clients and defend investigations or proceedings brought by the NCA.
The National Crime Agency (NCA) must satisfy the court with evidence that the property has been acquired using the proceeds of crime. This means that it’s only necessary to show that the property was obtained through offending of a particular type, for example drug trafficking or fraud. It does not need to be traceable to an individual (including the property owner) or a specific offence.
Our areas of expertise include:
- Defense of restraint and confiscation proceedings under the Proceeds of Crime Act 2002
- Managing fraud litigation, including deceit, fraudulent misrepresentation, breach of fiduciary duty, unjust enrichment, dishonest assistance
- Obtaining interim civil remedies to protect businesses and prevent dissipation of assets
- Negotiating with prosecuting authority to secure an agreed settlement
