Court of Protection

 

The new Court of Protection was established by legislation in 2005, empowered to make decisions that affect people who can no longer make decisions for themselves, primarily to deal with their property and financial affairs.

Where it is determined that a person lacks the mental capacity to deal with their own financial affairs, the Court of Protection can appoint a person (a Deputy) who is given the authority to make decisions on behalf of the mental incapacitated person concerning that person's property and financial affairs.
