Meaby & Co – Solicitors Specialising in Private Prosecutions
What is a private prosecution?
A private prosecution is a prosecution started by a private individual, or entity who/which is not acting on behalf of the police or other prosecuting authority. A ‘prosecuting authority’ includes, but is not limited to, an entity which has a statutory power to prosecute.
Meaby & Co work closely with a team of expert Barristers and Investigators who are frequently retained by the CPS, Police, Serious Fraud Office and National Crime Agency, to privately prosecute criminal cases. We have particular expertise in acting on behalf of Charities, Listed Companies and the Public Sector.
We regularly prosecute cases which feature the following characteristics:-
- Director / Employee Fraud
- Money Laundering
- Financial Fraud such as credit, insurance, tax and invoice duplication
- Tender Contract Fraud
- Bribery and Corruption
- Land Fraud
Private Prosecutions can act as a catalyst to procure two outcomes, both of which are attractive to companies who have been victims of fraud.
Firstly, a private prosecution acts as a deterrent aimed at reducing the likelihood that a similar act will occur within the company. Secondly, it can result in substantial recovery of monies lost as a result of the fraud.
We understand that in determining whether to bring a private prosecution, aside from the financial and commercial considerations, companies and bodies alike have to consider the reputational implications.
Meaby & Co therefore offer a comprehensive Reputation Protection and Crisis Management Service to all client’s who retain us in private prosecution cases.
This service is commences with an initial review by an independent publicist of the reputational risks associated with the case. The Publicist will then assist us throughout the case in ensuring that any adverse publicity is averted where possible or a positive spin or response applied where needed. The Publicist or a member of the team will also attend trial of any action in order to monitor reputational risk and exposure and advise on any press comments.
This service is provided at no additional cost to our clients as we appreciate how important our client’s reputation is.
